Eligibility

  1. The promoter of this contest is ExxonMobil Asia Pacific Pte Ltd (“ExxonMobil”) hereinafter referred to as the Contest.
  2. The Contest begins on 26 July at 12:00am (GMT + 8:00) and ends on 14 September 2012 at 11:59pm (GMT +8:00). All registered parties within the above stated period would hereby be known as “Participants” to this contest.
  3. Participants must be citizens or permanent residents (PR) of the following geographic areas during the Contest period:
    • Singapore
    • China
    • India
    • South Korea
    • Taiwan
    • Thailand
    • Philippines
    • Malaysia
    • Indonesia
    • Australia
    • New Zealand
  4. Participants are not required to make any purchase of EXXONMOBIL’s products to participate in this Contest.

Contest Mechanics

  1. To participate, participants need to visit www.mobil1.com.sg/willyoubetheone and register/log in on the Contest Site.
  2. The Participant who records the best score will win the grand prize.
  3. Participants who 'refer five friends' will stand a chance to win a replica sweatshirt.
  4. The Participant who records the best score for the Mobil 1 Racing Academy will win the grand prize of a trip to Austin, Texas to watch the 2012 United States Grand Prix.
  5. Contest entries cannot be amended by participants once it has been submitted.
  6. In the event that more than one Participant obtains the highest score at the end of the Contest, the Participant which obtained the highest score first will be deemed the winner.
  7. Participants will be responsible for all government, federal, state and local taxes payable (including, but not limited to income tax, value added tax, luxury tax or any similar tax imposed by any country in connection with the prizes and/or the contest.)

Qualifying Entries

  1. Employees (including their immediate family members) of EXXONMOBIL companies, its partners and subsidiaries, advertising agencies, public relations consultants, and others associated with the Contest, are not permitted to participate in the contest.
  2. Mobil 1 Racing Academy scores obtained before registration, will not be applicable to this competition.

Prizes

  1. EXXONMOBIL will choose one or more Participants from each country in the below geographic areas as a winner(s) of the 'limited edition' Mobil 1 Sweatshirt for the 'refer a friend' portion of the competition.
  2. 1 participant, from the below participating countries, will be awarded the grand prize of the trip to the 2012 United States Grand Prix in Austin, Texas based on the highest score captured by a participant on the Mobil 1 Racing Academy game. (Participants have to enter the game site through www.mobil1.com.sg/willyoubetheone to qualify for this prize):

  3. All names of winners will be published on the website in October 2012. The time of announcement may be moved earlier or later, at EXXONMOBIL’s absolute discretion. The decisions of EXXONMOBIL representatives shall be final and binding on all aspects of the contest. It is not necessary for Participants to be present at the judging and voting to win.
  4. Winners will be notified by email, phone and/or the website. As such, Participant’s e-mail address keyed in at registration must be genuine. Winners will also be notified of the method for collection of prizes upon notification of their win.
  5. Only a prize winner and not any other person or agent, may claim a prize upon presentation of valid identification documents. A notification letter will be emailed / posted to winners, which they need to present together with their valid identification documents to qualify for the prize.
  6. Each prize winner must confirm acceptance of their prize within a reasonable time. If EXXONMOBIL does not receive an answer from a prize winner within seven (7) working days after initial contact is made by EXXONMOBIL (through telephone and email), except when such period is extended pursuant to local law or EXXONMOBIL’s sole discretion, such winner will be disqualified. If a winner is disqualified for this or any other reason, such as being found ineligible or failing to comply with these Terms & Conditions, or if the prize remains unclaimed, then the first alternate will receive such prize instead, as will each of the subsequent alternates until all prizes have been distributed. EXXONMOBIL, its affiliates and/or representatives will use their best efforts to contact prize winners but will not be responsible or be liable in any way whatsoever if prize winners cannot be reached by telephone and e-mail within the seven (7) day period. Winners do not become official until all entries are validated. All decisions of EXXONMOBIL are final and irrevocable.
  7. All winners shall be required to complete a Release of Liability form, which will be sent via email. The form must be completed and returned to EXXONMOBIL within 14 days of receipt of the same. If any winner fails or refuses to comply with this requirement, EXXONMOBIL shall be at liberty to select a new / alternate winner.
  8. Prizes cannot be transferred, negotiated, refunded or exchanged, and by no means will a cash equivalent be given. In case the prize is unclaimed by the winner within the stipulated period, the winner shall be deemed to have surrendered his/ her right to the prize and shall not have any claim, thereafter and in such an event, EXXONMOBIL reserves the right to transfer the prize to the alternate winner. Prizes will be dispatched by EXXONMOBIL to the address provided by the winner (calls to winners will be made on the mobile number that the selected winners have filled at the time of registration for the game). EXXONMOBIL accepts no responsibility for any variation in the prize value. Where a prize is unavailable for any reason, EXXONMOBIL may substitute for that prize another item of equal or higher value as determined by EXXONMOBIL.
  9. If at any time during the Contest Period or after the Contest is over, a winner is found out not complying with the terms and conditions, mentioned herein, EXXONMOBIL reserves the rights to cancel the prize and may recover the claimed prize by appropriate legal recourse. EXXONMOBIL’s decision is final and no correspondence will be entertained.
  10. EXXONMOBIL has the right to substitute designated prizes with other prizes of similar or equal value in case it is necessary.
  11. Participants hereby agree to release EXXONMOBIL, its directors, officers, employees and agents, including without limitation, its parent companies, subsidiaries, affiliates, employees, agencies and branches, as well as all contest partners / sponsors and all others associated with the development and execution of this Contest, from and against any and all liability for injury, loss or damage of any kind (whether direct, indirect or consequential) with respect to or in any way arising from this contest and the awarding and the use or misuse or possession of any prizes awarded, including liability for personal injury, death or property damage, except where prohibited or limited by law. All winners acknowledge that to the extent permissible by law, the prizes are awarded by EXXONMOBIL on an “as is” basis without any warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, and non-infringement.
  12. Participants shall fully indemnify and hold harmless EXXONMOBIL, its directors, officers, employees, agents and assigns against any and all losses, liabilities, costs, claims, charges, expenses, actions or demands (including legal costs), whether direct or indirect arising out of a breach by him or her of these Terms & Conditions.

Liabilities

  1. EXXONMOBIL may at anytime, at its discretion, change the prizes mentioned in the Terms & Conditions and Contest Site without prior notice. The prizes are given subject to applicable taxes and any tax or levy shall be solely to the account of the winner. EXXONMOBIL accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought by the winner at the winner’s own costs.
  2. EXXONMOBIL, its affiliates and/or representatives are not responsible for any loss of contest submissions due to any problems caused by telephone lines or systems or internet service providers, for entries received after the deadline as a consequence of telephone or internet service delays, interruptions, failures or overloads, or for lost, stolen, misdirected, misplaced or postage-due entries. Contest submissions are void if unreadable, inaccurate, and incomplete, damaged, mutilated, tampered with, falsified, irregular in any way or otherwise not in compliance with these Terms & Conditions.
  3. EXXONMOBIL reserves the right to terminate, modify or extend this Contest, and its Terms and Conditions, at any time at its absolute discretion, without assigning any reason whatsoever. Decisions of EXXONMOBIL shall be final and binding.
  4. The Contest is governed by Singapore law and all disputes are subject to the exclusive jurisdiction of the courts of Singapore.
  5. Without prejudice to paragraph 25, if for any reason any aspect of this Contest is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of EXXONMOBIL which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, EXXONMOBIL may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries without any liability or any obligation to continue running the Contest.

Obligations

  1. By entering into the Contest and accepting a prize, prize winners agree that EXXONMOBIL has the right to picture, tape or portray them as Contest winners in any manner whatsoever as EXXONMOBIL may in its absolute discretion decide, and to exhibit this material in for all marketing and publicity purposes without any compensation whatsoever for advertising and publicity purposes, except where prohibited by law. Prize winners also consent to EXXONMOBIL’s right to use their name, voice, picture or footages, or the content of their entries.
  2. Participants confirm that their participation in the contest is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides and acknowledge that EXXONMOBIL does not make any representations (whether express or implied) in relation to the lawfulness of the Contest.
  4. All prizes will be awarded pursuant to these Terms & Conditions. All taxes in connection with prizes are the sole responsibility of each prize winner, unless provided otherwise in accordance with applicable law and regulations.
  5. Participating in the Contest constitutes participant's acceptance to these Terms and Conditions of the Contest. All promotional materials, including details on how to enter and claim prizes are part of these Terms and Conditions.
  6. By participating in the Contest, participants agree to receive promotion material about the Contest or any other Contest detail by SMS or email.

General Terms

  1. The invalidity or unenforceability for any reason of any part of these Terms & Conditions shall not prejudice or affect the validity or enforceability of the remaining parts and each part of these Terms & Conditions is distinct and at all times severable from the rest of the Terms & Conditions.
